The following terms and conditions are written in German and can be downloaded by the customer. They can also be requested in digital or written form at www.targetdarts.de or via email at kundenservice.

Target Sports Ltd operates a website for commercial purposes under the domain www.targetdarts.de. Dartshopper offers customers products, mainly darts equipment, for purchase online via this website.

(1) The customer has the option to select and order products on the above-mentioned website.

 

(2) For each product, the customer will receive a separate product description on the respective website.

 

(3) The customer can click on the desired products on the website. These are collected in a virtual shopping cart and at the end of the purchase the customer receives a summary of the products with the total final price including VAT and shipping costs.

 

(4) Before sending the order, Target Sports Ltd enables the customer to check the order for accuracy, in particular with regard to price and quantity, and to correct it if necessary.

(1) Consumers have a 14-day right of withdrawal.

 

(2) The reimbursement of shipping costs and the charge for return shipping costs in the event of cancellation of a goods order shall be regulated as follows:

 

Outbound shipping costs:

If you exercise your statutory right of withdrawal, we will not reimburse you for the shipping costs of the goods from us to you.

If the shipping of the ordered goods from us to you is free of charge due to the value of your order, and you only exercise your right of withdrawal with respect to part of the goods ordered, so that the part of the goods remaining with you does not reach the amount for free shipping, then you have to bear the shipping costs in the amount that would have been incurred if you had only ordered the goods remaining with you.

 

Return shipping costs:

In the event of exercising your right of withdrawal, you will bear the direct costs of returning the goods.

(1) The list prices at the time of ordering, as displayed on the website, shall apply.

 

(2) Prices are ex works Target Sports Ltd, including VAT but excluding shipping costs.

 

(3) Shipping costs depend on the delivery address and vary depending on the product. Delivery is free for orders over €50.

(1) The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the "Buy" button, you submit a binding order for the goods contained in the shopping cart.

 

Confirmation of receipt of your order, along with acceptance of the order, will be sent immediately after submission via automated email. The purchase contract is concluded upon receipt of this email confirmation.

 

(2) If Target Sports Ltd has not delivered within 30 days of order confirmation, the customer may terminate the contract without notice and without having previously put Target Sports Ltd in default.

 

(3) We will save the contract text and send you the order details and our terms and conditions by email. You can view your past orders in our customer login area, provided you have registered an account with us.

 

Target Sports Ltd is entitled to cancel and credit orders at any time for any reason.

Provided the ordered products are available, Target Sports Ltd will deliver them within 3 to 4 working days after receipt of payment if prepayment has been agreed, otherwise after receipt of the order, unless different delivery times are specified for the individual products.

 

Changes, additions, limitations to the order

Target Sports Ltd provides an email address and a contact form for customer inquiries about products. This is available 5 days a week (Monday to Friday), excluding UK public holidays, during business hours (8:30 am to 4:30 pm) UK time.

 

Copyright and image rights

The content on our website is protected by copyright. Any use of content to which we hold or have acquired rights, beyond purely private use, in particular its publication or distribution, including on or via social networks, requires our express prior consent.

 

Packaging, packaging material

In accordance with the regulations of the Packaging Ordinance, we are obliged to be affiliated with a certified company of the so-called dual system for the recycling of packaging material.

Consumers have the option of placing the packaging in the waste paper collection, along with old newspapers, etc. Necessary non-material components, such as adhesive tapes, labels, and the small amount of film, do not interfere with the recycling process.

(1) Target Sports Ltd will issue an invoice to the customer for the ordered goods, which will be handed over upon delivery of the goods or sent by email, unless the relevant information is already included in the confirmation email. The customer waives the right to receive a paper invoice.

 

Target Sports Ltd delivers against prepayment or invoice via credit card, Giropay, SOFORT Banking or PayPal.

 

Prepayments or credit card authorizations will be taken into account when invoicing. Your credit card will be charged upon completion of the order.

 

When purchasing on account, the ordered goods are shipped or delivered to the customer together with the invoice. The purchase price is due for payment within the period stated on the invoice. 

 

In the case of delivery against invoice, the purchased item remains the property of Target Sports Ltd. until the purchase price has been paid in full. Prior to the transfer of ownership, pledging, assignment as security, processing or modification is not permitted without the express consent of Target Sports Ltd.

 

Target Sports Ltd delivers against prepayment or invoice via credit card, Giropay, SOFORT Banking or PayPal.

Payments are processed securely through our payment service provider, who offers you various payment options.

 

Depending on the result of a credit check, we reserve the right not to offer certain payment methods and to refer you to our other payment methods.

 

(2) Prices on the invoice are always end-customer prices including VAT.

 

(3) In the event of late payment, the customer, if a consumer, shall be obliged to pay default interest to Target Sports Ltd at a rate of 5% above the base interest rate, unless Target Sports Ltd can prove a higher interest rate.

(1) Defective or incorrectly delivered products must be reported to Target Sports Ltd. in writing within 48 hours of delivery, including photographs. The products must be returned in their original packaging and in new condition.

 

Unless expressly agreed otherwise, your warranty claims are governed by the statutory provisions of the German Civil Code (Sections 433 et seq.) and are therefore valid for 2 years from receipt.

 

You are obliged to inspect the goods immediately and with due diligence for deviations in quality and quantity and to notify us of any obvious defects immediately upon receipt of the goods.

 

(2) Unlimited liability: We are liable without limitation for intent and gross negligence as well as in accordance with the Product Liability Act.

 

Furthermore, the following limited liability applies: In cases of slight negligence, we are only liable for breaches of essential contractual obligations, the fulfillment of which is essential for the proper performance of the contract and on which you may reasonably rely. Liability for slight negligence is limited to the amount of damages foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. This limitation of liability also applies to our vicarious agents.

 

Any contributory negligence on the part of the customer must be taken into account.

 

Liability for intent, warranty, fraud and for personal injury and damage to health as well as under the Product Liability Act remains unaffected.
